Someone replies to a cold email asking to be removed. What is the right compliance handling here?

What CAN-SPAM actually requires: Honor opt-out requests within 10 business days. Include a functioning unsubscribe mechanism. That is it. No law requires you to send a confirmation email acknowledging the unsubscribe.

What GDPR requires (for EU recipients): Stop all processing of the person\'s data including further email contact. Delete or anonymize their record unless you have another legal basis to retain. Confirmation is not required but is considered best practice.

What most agencies actually do. Silent unsubscribe. Remove from list immediately. Do not reply. Do not send confirmation. The reasoning: any reply you send to a frustrated prospect who asked to be removed is just another unwanted email. Sending "sorry, you have been removed from our list" to someone who asked to be removed is tone-deaf.

The one exception: If the reply was an automated out-of-office or auto-reply that just happened to contain the word "unsubscribe" in the signature, you do not need to actually unsubscribe them. Use an AI reply classifier or manual review to separate real unsubscribe intent from noise.

The DNC list play. Maintain a master do-not-contact list across all your clients (for agencies) or campaigns (for in-house). If someone unsubscribes from one campaign, make sure they are blocked across every campaign from your entire operation. One unsubscribed prospect getting emailed again from a different sequence is a compliance violation and a spam complaint waiting to happen.

Silent unsubscribe. Automated detection. Cross-campaign DNC lists. That is the standard. Do not reply.
